Cop Broke a 73-Year-Old’s Arm, Then Fist-Bumped — 5 Years in Prison
“You come on. I’m here.”
“I don’t know.”
“Are you finished?”
“All right, let’s stop. Ma’am, I don’t think you want to play it this way. Ma’am, police, stop.”
“You want to stop? Lights on. Siren. Stop. You just left Walmart. Do you need to be arrested right now?”
“No.”
“No.”
“No.”
“Okay, let’s stop. Come on. Come on.”
“I’m going home.”
“Just the number. I’ll pay it off later.”
“No, no, no.”
“On the ground. Stay on the ground.”
“I’m going home. I’m going home.”
“On the ground. On the ground.”
“On the ground.”
“After a short struggle, she’s now detained.”
“Come on.”
“Why did you do that?”
“I told you to stop. You don’t get to act this way. Come on.”
“Stay on the ground.”
“All right, let’s stand up.”
“Why are you doing this, ma’am?”
“All right, stand up.”
“I’m not doing anything right now.”
“You’re resisting, which is not going to fly with me. And before that, you tried to steal from Walmart, and they caught you and took the stuff back.”
“Now, why are you trying to slip the cuffs off?”
“I’m going home.”
“Stop.”
“I’m going home.”
“No, you’re not. Are you finished? Are you finished? We don’t play this game. You understand me? And if you try to kick me, oh, this is going to be bad.”
“I’m going home.”
“Stop.”
“I’m going home. I’m going home. I’m going home.”
“Help you?”
“Are you finished?”
“I’m going home.”
“Hey, stand up. We’re not going to hold you.”
“All right, let’s just go to the ground. On the ground. On the ground.”
“Why are you doing this? Let me see who she is.”
“I’m going home.”
“I’m wearing your car.”
“Yeah, I know. I’m just trying to search her real quick.”
“Oh, no.”
“On the ground. On the ground. On the ground.”
“I’m pushing. There we go.”
“All right. Sit down.”
“I’m going home.”
“Two. Three.”
“Come on. Stand.”
“Yep.”
“All right. Sit down.”
“Okay.”
“You got him?”
“I have this.”
“Hey, we’re going to sit in the car. Okay?”
“How you throw the little kid?”
“Well, I don’t know. He’s not a little kid.”
“And this is what happened: he was just walking and I see you got him. Stole from Walmart and refused to stop, refused to listen to lawful orders, and to fight me. This is what happens when you fight the police. I have to use force to safely detain her. This is what happens when you fight the police.”
“Do you know who she is?”
“No.”
“Do you know where she’s coming from?”
“No.”
“Do you know what crime she’s committed?”
“I just see her coming.”
“Do you know what crime she’s committed?”
“Well, I just see her walking right there. You know, I’m just asking you, do you know any of the story? So all you did was just take a brief little view of it, and you don’t know the rest of the story.”
“I usually, I would think that the police have a reason to arrest her. That’s what all the time…”
“You see what happened not too long ago, you know.”
“Is there anything I can do for you today?”
“Well, no. I just see that, you know…”
“Okay. Well, I appreciate that. I appreciate your concern. She committed a crime. She ran from the Walmart. That officer caught up to her over here, and she resisted arrest, and she’s under arrest for criminal charges of theft…”
“Yeah.”
“And obstruction, and resisting.”
“Yeah.”
“Because the fact, you know, by seeing it here, she wasn’t…”
“So I would caution you next time if you want to videotape and make sure everything’s okay that you stay a little further back, because had this turned into a violent encounter or she had pulled a gun, you and your family would have been in the mix. Okay? Because you put them…”
“So you have a complete lack of trust of police because you watch the news?”
“I understand that, than yours, because it’s had to happen to me too.”
“Okay. Well, again, I’m going to caution you about getting this close and involving yourself in law enforcement situations. If you want to videotape and monitor it, you could have done it from much further back. You inserted yourself into the situation.”
“They were right there fighting with her. Had she pulled a weapon, you would have been right…”
“Already on that car when I pull here.”
“You hear what I’m saying. If you do this every time, every time we have a call, did it today, you know, and…”
“Okay. Well, you’ve said it three times. I got it. If you want to file a complaint on the officers, you feel free to do that.”
“Okay. Just letting you know, you know, because he didn’t do anything wrong.”
“He didn’t do anything wrong?”
“She committed a crime.”
“Yeah, I don’t know about if you commit a crime, if you go and steal something, and you run from me, and you talk, and you resist, then you’ll get taken to the ground, too.”
“I hit my light, siren. She kept walking, said, ‘Please stop. Stop.’ And she looked at me, kept going, saying, ‘No, I’m going home.’ So I went up to grab her, started pulling away from me and stuff like that. So I was just by myself, so I went to the ground, struggled, and rolled for a little bit.”
“Um, I see that.”
“Yeah. Yeah. And then I got her detained. She showed up while I had her up against the car ’cause I couldn’t get her in the car, and right all that stuff. So we struggle over there for a little while, and then we brought her into this car ’cause mine was locked.”
“Okay.”
“And she wouldn’t get in. She’d get in, wiggle out, get in, wiggle out, all this stuff.”
“Has she been drinking or something, or…”
“I have no idea. She hasn’t talked to me much.”
“Okay. All right. Good. All right. Um, let’s get out of the station. Yeah. Go from there.”
“Karen, I got your credit card. Okay? It’ll go with you.”
“What’s your date of birth, Karen?”
“I have it.”
“You will have it with you. I will not lose it. I promise. What’s your date of birth, Karen? What’s your date of birth? What’s your date of birth?”
“Okay.”
“Negative. Sorry. I got nothing else. It’s just from a credit card she has.”
“She’s probably like 4’10”, 5-foot, maybe like 100 pounds.”
“I just drive down the block.”
“How old are you?”
“She’s 73.”
“Uh, she’s 73.”
“Oh, you were good. Had her handled. If it was a big dude, it’d been different. But she was like 20 pounds.”
“I had…”
“You’re not getting out of that door.”
“Yeah, she’s hiding there.”
“She stole some stuff, and they caught her before she left and got it back when she ran out. So we have the…”
“And then you contacted her for that, and then she resisted. So we’re good either way.”
“So we’re good either…”
“Either way, she’s going.”
“All right. If they decide not to prosecute, I don’t care. We’re going to the female side or male side, okay? We got the cell there if we need it.”
“There’s an uncle…”
“No, I didn’t know that.”
“I didn’t know that either.”
“Hey, you got the door open.”
“Come on, Karen.”
“I’m going to run.”
“You’re going to run? Oh, good thing we got the hobble.”
“If they decide not to prosecute, I don’t care.”
“Somebody did decide to prosecute. Not her. Him.”
“Hop? What have we got?”
“You was like, ‘Short star machine today.'”
“Yeah, we talked a little bit, but she pulled it. I was like, ‘We’re going to say, “Hey, I’m fighting. I have everyone.”‘”
“Yeah, I was like, ‘I’m fine. I can handle it.’ I mean, I was like, ‘All right, let’s all…'”
“She spit on you.”
“Nothing like that. She didn’t want to come with us. I used the force with that light control down a couple times.”
“Did you catch your…”
“I don’t think so.”
“Let’s wreck it.”
“What’s up, man?”
“Ma’am, hey, I don’t think you want to play this way, man. Please stop.”
“You don’t want to stop the lights on, siren? Stop. You just left Walmart. Do you need to be arrested right now?”
“Okay.”
“I love it. I hate it. I hate it.”
“Somebody says.”
“She leaves the room at 49 minutes. She never calls a medic either.”
“You hear?”
“Well, she’s still fighting you in the backyard.”
“Yeah.”
“Good way to go. Get out of here.”
“Is this a red car?”
“No, not there’s no reason.”
“Well, I I think this is takes an action that results in or is alleged to have resulted in injury and stuff. Why don’t we, uh, go to take her out, we’ll put her face down in there. Take your cuffs off, I’ll put mine on in case you go running off to another, but we can throw my cuffs on there.”
“A red star is the flag that sends a use of force report up the chain for review. He’s asking whether this one needs it. Nobody in the room knows. So they read the policy off the screen: Injury or death to another person.”
“I hit my light, siren…”
“Very excited.”
“Like…”
“I was super excited.”
“Did you catch her?”
“I don’t think so.”
“Let’s get out of here.”
“That’s how…”
“Yeah, you were…”
“You were…”
“Great. Thank you.”
